John Pimblett & Sons Ltd operated a bakery. The commissioners argued that the pies were hot when sold and therefore were standard rated hot takeaway food. The baker won on the argument that the pies were sold fresh made pies and not hot pies and were not heated so that they can be consumed above the ambient temperature.
